Terms and Conditions

1. Scope and Contracting Party

These Terms and Conditions apply to all retreat bookings made through the website italian.seryberry.ch. The organizer is:

By completing a booking, the participant accepts these Terms and Conditions as binding. Any deviating conditions of the participant shall only apply if confirmed in writing by the organizer.

Available spots are limited. Bookings are processed in order of payment receipt.

2. Registration and Contract Formation

Registration takes place via the booking form on the website. By submitting the form and paying the full retreat price, the participant makes a binding offer to enter into a contract.

The contract is concluded once the organizer confirms the booking. The organizer reserves the right to decline bookings without stating reasons; in such cases, any payment made will be refunded in full.

3. Prices and Payment Terms

The applicable total price is displayed on the retreat page. All prices are in Swiss Francs (CHF).

Payment: The full retreat price is due at the time of booking. The spot is considered reserved upon receipt of the full payment.

If a payment remains outstanding despite reminders, the organizer reserves the right to withdraw from the contract and re-offer the spot. Any payments already made will be handled in accordance with the cancellation policy in Section 4.

4. Cancellation by the Participant

Cancellations must be submitted in writing (email) to the organizer. The applicable cancellation fee is determined by the date the cancellation is received relative to the retreat start date:

Any payments already made will be offset against the applicable cancellation fee. If the amount paid exceeds the cancellation fee, the difference will be refunded. A processing fee of CHF 300 is non-refundable in all cases.

Participants are strongly advised to take out travel cancellation insurance.

5. Cancellation or Changes by the Organizer

The organizer may cancel a retreat if the minimum number of participants is not reached, or if force majeure (e.g. natural events, official orders, illness of the retreat leader) makes it impossible to proceed. In such cases, all payments made will be refunded in full. Further claims are excluded.

Minor changes to the program, location, or retreat leader are reserved, provided the overall character of the retreat is maintained.

6. Insurance and Personal Responsibility

Participation is at the participant's own risk. Adequate health, accident, and travel insurance is the responsibility of the participant. By booking, the participant confirms being physically and mentally fit to participate, and agrees to inform the organizer in advance of any relevant health restrictions.

7. Liability

The organizer is not liable for damages outside their sphere of influence, nor for loss or damage to personal property. Liability for slight negligence is excluded to the extent permitted by law. This does not affect liability for damages resulting from injury to life, body, or health, or from intent or gross negligence.

8. Data Protection

Personal data collected during the booking process is used exclusively for contract processing and will not be shared with third parties without consent, except for payment processing service providers. The privacy policy published on the website applies.

9. Applicable Law and Jurisdiction

Swiss law applies exclusively. The place of jurisdiction is Zurich, Switzerland, unless mandatory legal provisions require otherwise.

10. Severability Clause

Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a regulation that comes closest to the economic purpose of the original.
